The West Canada Creek Project (Project) is currently licensed by the Federal Energy Regulatory Commission (FERC) under the authority granted to FERC by Congress in the Federal Power Act to license and oversee the operation of non-federal hydroelectric projects. The current operating license for the Project was issued on March 18, 1983 and expires on February 28, 2023. In accordance with applicable regulations at 18 C.F.R. § 16.9(b), Erie Boulevard Hydropower, LP (Erie) must file its application with FERC for a new license no later than February 28, 2021. In support of preparing an application for a new license, Erie has elected to use the FERC’s Integrated Licensing Process (ILP).
